Methembeni is an experienced lawyer and an admitted legal practitioner of the High Court of Zimbabwe. Mett (as his friends would call him), has practised Mining Law in Zimbabwe and Construction Law in South Africa and has extensive cross-border and African commercial transaction experience.

Prior to joining NSDV, Mett worked for a global law firm as a Zimbabwean counsel and advised on large cross-border mining transactions, also for a specialist construction dispute resolution law firm in Johannesburg where he worked on complex and high-value adjudications and arbitrations arising out of FIDIC, NEC3, and bespoke construction and engineering contracts.

Mett was a project manager at a leading global legal technology company where he provided specialist advice to a multinational mining company and helped the company negotiate and conclude numerous capital expenditure goods and services contracts with its strategic suppliers. He typically acts for major and junior miners, exploration companies, and construction employers and contractors.

Mett’s experience includes:

• Complex adjudications and arbitrations, arising out of Fédération Internationale Des Ingénieurs-Conseils (“FIDIC”), the New Engineering Contract (“NEC3”), and bespoke contracts.

• Reviewing, drafting, and negotiating commercial contracts in the mining sector.

• Advising clients on the acquisition and maintenance of mining and exploration rights.

• Environmental management compliance.

• Exchange control.

• Foreign currency and other legislative risk mitigation solutions, including drafting government and miner agreements with stabilisation clauses.

• Advising clients on local content and local entity incorporation for purposes of complying with various local procurement laws.

• Conducting legal due diligence exercises on mining right holders.
